BREAKING: Over 80 Maine Legislators Send DHS Letter Demanding Accountability for ICE Shooting Death of Johan Sebastián Durán Guerrero

July 29, 2026, Earlier this morning, Speaker Ryan Fecteau, 65 State Representatives, and 16 State Senators, sent a letter to DHS Secretary Markwayne Mullin regarding the fatal shooting of Johan Sebastian Durán Guerrero by ICE officers in Biddeford on July 13.

The letter reads as follows:

"Dear Secretary Mullin:

We, the undersigned members of the Maine Legislature, write to express our horror at the recent fatal shooting of Johan Sebastian Durán Guerrero in Biddeford, Maine. and to demand accountability and reform.

Mr. Guerrero was shot on a residential street in Biddeford on a Monday morning, by U.S. Immigration and Customs Enforcement (ICE) officers operating under the authority of the U.S. Department of Homeland Security. Mr. Guerrero was reportedly not the intended target of the ICE operation, and he was shot to death by DHS officials while inside his vehicle.

The tragic killing of Mr. Guerrero is another disturbing fatality in a growing list of similar incidents involving ICE agents across the United States. Let us be clear: these deaths at the hands of ICE agents are not simply unacceptable. They are unconscionable.

ICE has ramped up enforcement operations in recent weeks, conducted with what appears to be little or no regard for public safety or human life. Witnessing our neighbors being shot in the street has further decimated confidence in the credibility of DHS, especially as it becomes clear that none of the DHS officials involved in Mr. Guerrero's death and other recent fatalities were wearing body cameras, or the cameras were not activated. This blatant disregard for congressional direction to acquire and distribute body-worn cameras as a way to increase public trust is disgusting and, indeed, shameful.

The reckless behavior of ICE agents and the subsequent lethal consequences of thein actions are not just endangering our neighbors and communities -they are eroding confidence in law enforcement at all levels. This does not serve to make any Mainer or American safer. It only sows fear and terror among good, hardworking people.

As our communities mourn Mr. Guerrero, we call on you to ensure that DHS continues to cooperate fully with the investigation by Maine's Office of the Attorney General and the Department of Public Safety, to ensure a transparent and thorough accounting of the failures that led to his death.

There is no doubt that comprehensive reform of ICE is critical to restoring public trust in the work of your department. We join Governor Janet Mills and Senator Angus King ir calling for accountability, greater transparency, and changes that prioritize public safety during enforcement actions. Mr. Guerrero should not have lost his life. No one should be killed at the hands of ICE agents, in Maine or anywhere in the United States.

Let us also be clear - this demand for reform and accountability is not at odds with our support for removing dangerous convicted criminals from our communities. We demand that any such actions taken with that goal in mind be conducted with respect for the due process and constitutional protections this nation's laws guarantee. They should in no way endanger the lives of our neighbors or jeopardize public safety in any community, The actions by ICE agents in Biddeford on July 13th took Mr. Guerrero's life and endangered others in the process.

Maine people, and all who call this country home, deserve clarity and accountability from DHS and from you, Mr. Secretary."
