📰BIDDEFORD | Mayor LaFountain Issues Statement Following Court's Dismissal of City's Complaint

March 23, 2026, the following statement was sent directly to the Biddeford Buzz today from Biddeford Mayor Liam LaFountain regarding the recent dimissal of a court case brought forward by the City pertaining to the University of New England’s proposed pier.

Mayor LaFountain writes:


“I am disappointed that the case will not be heard, but asking for transparency, open government, and a sound process was the right move. It's what Biddeford residents deserve.


The City brought this complaint forward after new information came to light, suggesting that a prior decision related to the Saco River Corridor buffer zone may not have been considered during the approval process. Given the significance of that issue, seeking clarity through the courts was appropriate and done in good faith.


It is important to note that the case was dismissed on procedural grounds related to timing, rather than on the merits of the legal arguments the City raised. The Saco River Corridor Commission acknowledged in public comments that a mistake had been made, and the purpose of this action was to ensure that concern was fully examined and not overlooked.


My focus remains on ensuring that future decisions, particularly those affecting the Saco River, are made transparently, follow the proper process, and reflect the long-term interests of Biddeford residents. I will review the court’s decision with the City Council and legal counsel and determine what, if any, next steps are appropriate.”
